They could, but they won't, if he's truly dead. Which I suspect is the case.

They know this new policy is extremely unpopular, and they don't want to have to admit fault, in which they would lie and try to blame it on Biden and Obama's "weak immigration policies," even though Obama deported more illegal aliens than any other President until then.
