the AFT said they're reserving the right to file a lawsuit in their Cease and Desist. I hope they pursue it.

What they did is felony mail fraud, so yes. If postal police or the DOJ pursue it, they can absolutely be charged.

They real question is will they be charged?

To me the real question is, will everyone continue simply to pretend the system is legitimate, as though sustained by magic, despite consistent and robust failures?
