So it does violate some core rules of both FS an OS. Also the text is so full of legal holes which makes it useless in it's goal too. It only prevents good-intent individuals from contributing and acts as a tool in hand of big evil corpurates.

From a software engineering POV Photoshop is a bad software (against unix philosophy) and no Free Software wants to be a bad software, so forget about feature parity and use different apps for different things that mistakenly all done by Photoshop.

No. It's not Open source at all!
