It's good to hear that there's some more scientific studies showing that gender and sex are distinct facets of our biology. Sadly, I'm skeptical it will do much to sway the bigots, but any good news is positive news!

The only thing worse than making him a martyr would be failing to make him a martyr. If he had died, the person taking his place wouldn't have the same die-hard following or charisma as he does. Now, he gets to reap the same benefits as if he were martyred, without the disorganization and fragmentation of someone trying to fill in his shoes.

This is truly the worst timeline.

Nintendo's angle is more along the lines of:

  • We gave our friend Switchy the keys to a lockbox.
  • You tricked Switchy into giving you our keys.
  • We didn't authorize you to use those keys.
  • Using our keys without our permission is circumventing our DRM.
  • Yuzu is a tool that enables you to use our keys.
  • It's illegal to distribute tools to circumvent DRM.

It's a massive reach, but it's a plausible argument—or even a good one if the judge is a technologically illiterate luddite. Beyond that, Nintendo is the kind of litigant that will drag out a lawsuit until the other party is forced to settle.

I'm pretty impressed with The Verge this time around.

They did a very good job quickly explaining the legal stance and argument that Nintendo has with their lawsuit, what needs to happen for it to be successful, and how the precedent set in 1999 around emulators isn't applicable to this suit.

TCP is also deciding to ramp up the amount of boxes you kick over until the post worker gets crushed by boxes, at which point you decide to lower your box-kicking rate by half and try again.

I know a lot of people idolize him, and that's probably not healthy, but he just gets it. Provide value and convenience for consumers, and consumers will stick around. Be an inconvenience while squeezing consumers for money, and we'll leave with a parrot on our shoulders and a one-finger salute.
