Makes me wonder what they think would stop a future administration from snatching them and whisking them off to a black site with no opportunity for due process. Fastest way to rebalance the court. And at least as justifiable under the alien enemies act (can't be less than not at all).

The Supreme Court going venue shopping, something the conservatives love to rail against. Lovely. Let me attempt to explain this very poorly. This stems from a class action suit from those deported. We have different federal appeal courts covering different areas of the country, 13 of them. Some are considered leaning ideologically more one way than the other. This one was being held in the DC circuit (very centrist imo) which is a sort of catch all. The argument for staying in DC (liberal justices wanted this) was because it was too difficult to figure out where all of these people came from or how many jurisdictions their rights had been violated in - so DC could handle that being the catch all.

The Supreme Court was asked by the DOJ (not exactly but stay with me) to change the venue to Texas instead, and I believe the argument was something about being obvious that that’s where they were all deported out of? This is what the conservatives wanted. The (not stated but very clear) reason for this is because the southern circuit as the name would imply (they’re each numbered but often called by region) is a much more conservative venue. DOJ now get their venue change and yeah that sucks.
