Changing USA's constitution requires a 2/3's vote in both House of Representatives and Senate, plus ratification by 3/4's of the States (i.e. 38 States).

Right now, neither side has the numbers to pass a constitutional amendment.

Republicans control 28 states, Democrats have 18, and 4 are split.

At the Federal level, the House and Senate are both close to an even 50/50 split.

It matters for passing a Constitutional amendment, but I do totally get your point. Rather than amend the Constitution to legalize an action he wants to take, he'll just illegally do the action, then an army of talking heads will jabber incessantly some reasoning for how it is not illegal.

How that plays out is uncertain, but that'll be how they do it.

The Constitution has as much power as the paper it’s written on if the judicial branch won’t use it as a guideline, the executive branch does whatever they please, and the legislative branch codifies the new behavior after the act, which is then allowed to stand because the judicial branch doesn’t care if it’s unconstitutional.
