I attempted to fight Marcus at level 36 and got promptly wiped. So I would say lvl 36 is not it.

I figured out a work-around. I'm not a technical expert so memory leakage? I dunno.

If you log out to the title screen and then log back in, it fixes the issue. I do that now before any boss fight.

I'm having the issue where pals won't move to attack in sealed boss areas. They only attack if the boss goes near them. They still won't move afterwards.
