According to Hermosillo, he was visiting his girlfriend’s family in Tucson from his home in Albuquerque, New Mexico. Several hours before his arrest, Hermosillo was transported to a hospital in Tucson by ambulance after suffering from a seizure. He has a New Mexico state ID, but did not take it with him during the medical emergency.

After being released from the hospital following treatment, Hermosillo did not know how to return to where he was staying. He approached the Border Patrol officer because he was looking for someone to help him. “I saw a car, and I ask[ed] him for help,” Hermosillo said. He told the officer that he was staying in Tucson.

“You’re not from here. Do you have your papers?” the officer said, according to Hermosillo. When the officer asked where he was from, Hermosillo said he told the officer, “New Mexico.” The officer then accused Hermosillo of lying. “Don’t make me [out] like [I’m] stupid,” the officer said. “I know you’re from Mexico.” After that, Hermosillo said, he was arrested.

Never before in my life did I think “Where are your papers?” was a phrase that would ever be uttered by US law enforcement. Truly we live in an age of marvels.

Dude, have you ever been there? US law enforcement always had been a dick to everyone. I had law enforcement scream in my face so hard that I got spit on my face, and all I did was ask a question if I could be allowed to stay with my fiance whilst she would be locked up because we had to make a stop in NY and she didn't get a visa in time. Then during the entire time there I was yelled at, got a gun pointed at my because the metal detector bleeped on my belt which I had forgotten to take off. I had another one purposely smash multiple hard drives on a desk because I had the audacity to ask if she could be careful with that...

This was twenty years ago in NY but I have loads of other fun stories in the US.

Just don't talk to any police, about anything, no matter who you are. If you are legally obligated, or they don't care if you are or not, you need legal representation to inform any interaction with the authorities.

This. Do not talk to police without your lawyer present.

There is an old video on YouTube called "Never talk to the police" (or something very similar). A lawyer explains why it is bad. Then a police detective comes up and says everything the lawyer just said it's correct.

If they cared about keeping the threats tightly limited to only "bad illegals", they'd make it a priority to verify and release anyone who claims to be legal ASAP. If that was their true goal, these fuckups would be seen as a major risk to the goal. But it isn't. It was never about enforcing immigration law.
