"We were doing some shady shit with your data and the world caught up to this so we now found a new loophole and thus had to update our privacy terms. Love and kisses."

Samsung says I have to accept their privacy policy to continue using my phone. I have ignored that push message for like 4 years out of pure spite... I wonder what would happen if I did end up in court for some reason. I assume their lawyers would just argue that me using the phone is accepting the policy, whether I have read the policy or not.

If it's a free service it's definitely not in your favor. If it's a pair service, still most likely not in your favor.

I always remember that case where someone got injured at Disneyland and part of their Disney plus subscription is an agreement they can't sue Disney.

[–] DonGirses@lemmy.world 32 points 2 days ago (2 children)

IIRC they died(?) due to allergens in food that was supposed to be allergen free and due to their D+ subscription they waived their rights to sue (bullshit)

[–] Zephyr@sh.itjust.works 10 points 2 days ago (1 children)

Definitely more fucked than I remembered.

[–] scutiger@lemmy.world 17 points 2 days ago (3 children)

That's what Disney lawyers argued. I don't think it actually worked out for them, but I may be wrong.

Yeah it didn't work, everyone saw through the bullshit. They tried to settle through arbitration and keep it out of court. But that's because Disney lawyers are scum and will do anything to find a loophole to exploit. Also think they were more concerned about the publicity and why they wanted it settled silently.

The ultimate settlement at court was assumed to be pathetic though for killing someone. Think final amount wasn't publicized, but the publicized settlement record claimed the husband was seeking 50k. But I guess it can settle for higher and that was just a formality amount?

Anyhow they probably threw chump change at him and a lifetime membership of Disney+ and discounts at the parks. Certainly bundled with a NDA agreement to not disclose the settlement agreement or they'd claw it back.

Any lawyer who would willing go into a court room and argue that is literal human garbage.

[–] Frozengyro@lemmy.world 3 points 2 days ago (1 children)

I hope not, that's sickeningly evil. God forbid you just do the right thing...

[–] ironycanal@lemmy.dbzer0.com 1 points 2 days ago

Well, shareholders, but close enough.

[–] wonderingwanderer@sopuli.xyz 2 points 2 days ago

That is so fucked up. The family should sue to have the terms stricken from the agreement and then sue for killing their person. Some jurisdictions don't allow bullshit in the T&Cs like that.

But also Disney has a whole department of the most expensive lawyers in the world, so they'll probably have to find a real heavy-hitter who does pro bono work.

Or a family member who doesn't have D+ could sue...

[–] StumblingWasabi@lemmy.today 6 points 2 days ago

Injured? IIRC the person died.

[–] ironycanal@lemmy.dbzer0.com 4 points 2 days ago (1 children)

That's what they get for not pirating.

[–] harmbugler@piefed.social 4 points 2 days ago (1 children)

My lawyer advised me to pirate media to reduce my legal exposure. Just kidding... for now.

[–] ironycanal@lemmy.dbzer0.com 4 points 2 days ago

No, it's good advice.

[–] dan@upvote.au 3 points 2 days ago* (last edited 2 days ago)

It's crazy that forced arbitration is legal in the US.

[–] LovableSidekick@lemmy.world 25 points 2 days ago

Yes, just like HR is there for employees.

[–] MalReynolds@slrpnk.net 22 points 2 days ago (2 children)

I have altered the deal. Pray I don't alter it further.

[–] airbreather@lemmy.world 5 points 2 days ago* (last edited 2 days ago)

This deal is getting worse all the time...

[–] TwistedTurtle@sh.itjust.works 3 points 2 days ago

Cloud services in a nutshell.

[–] bjoern_tantau@swg-empire.de 21 points 2 days ago (1 children)

That actually is a regular occurrence when their previous terms are judged to be illegal.

[–] can@sh.itjust.works 6 points 2 days ago

That's still ultimately looking out for themselves

The same thing with how a "New and Improved" product is never improved for the benefit of us. It's improving their bottom line.

[–] sunsofold@lemmy.zip 2 points 2 days ago

It's absolutely for your benefit! Oh, wait, did you say user? I thought shareholder. No, you can get in line for the rectal probing with everyone else.
