Latest angles show the gun had been removed and the other agent had enough time to see. Also the suspect was face down on the ground before he was shot in the back.

Homeland Security shares account of fatal shooting The Department of Homeland Security said federal agents were conducting a "targeted operation" in Minneapolis at 9:05 a.m. Saturday looking for "an illegal alien wanted for violent assault."
"An individual approached U.S. Border Patrol officers with a 9 mm semi-automatic handgun," the agency said in a statement. "The officers attempted to disarm the suspect but the armed suspect violently resisted."
"Fearing for his life and the lives and safety of fellow officers, an agent fired defensive shots," the department's statement continued. "Medics on scene immediately delivered medical aid to the subject but was pronounced dead at the scene."
DHS said the man had two magazines and "no ID" and that more information would be coming.

Keep in mind, the only alternative to the Minnesota state government resisting the feds directly is armed, citizen militias, which will be way the fuck more bloody. ICE can possibly be intimidated by the national guard, but especially against citizens, they're not going to just tip their hat and leave.
It would be a coup at that point. The national guard is commanded by the Governor of the state, but the President can also legally override the governor and take control.
Always the passive voice. Even international media is apparently scared to say what we all see clearly from multiple angles on video: ICE grabbed him, wrestled him to the ground, beat him, held him still and unloaded about 10 rounds into him at point blank range.

I will never understand how we can push the second amendment so hard, and then use having a gun as an excuse to kill civilians. Furthermore, I will never understand how the 2A crowd will then also use that excuse as a justifiable reason for someone to be killed by law enforcement.
