While that’s true, juries are still less likely to convict when the death penalty is on the table, because they feel bad about it even if they’re theoretically in favor of it

This could actually work in his favor since it is much harder to get a death penalty charge to stick than say life in prison, especially in NY.

I think with the credible allegations of breaking chain of evidence on the backpack, manifesto, and weapon, could be enough to at least get a hung jury.

Already seeking the death penalty when the trial hasn't even begun and is by all accounts built on illegally obtained and most likely planted evidence. If America was really a just country, this wouldn't even make it to jury trial.
